I have been approached by a member of a Car Owners Club
can I make some pens was the question

What are legality of copyright on car logos? anyone done anything similar?
any thoughts?

I guess logos have copyright on them but I can't see a car manufacturer taking someone to court because they've make a pen with their logo on it. You might just have to send them one :thumbs:

They are copyrighted and you would need to seek permission to print them, especially if you are using them for commercial gain. If you see a logo in a magazine and cut it out and stick that on a pen then as long as you are not trying to pass them off as Merc Pens for example then you should be okay. If you printed the logo for making one for yourself then it's unlikely you would ever have a problem unless you tried to sell it.

Ask Dan about copyright infringement. I have had quite a few decent copyright infringement wins against copy shops, why should someone copy my copyrighted item for free especially for commercial gain.

Not sure on the copyright rules in relation to this my daughter is a F1 fanatic and she has a number of different pens that she has got from the different constructors with their logos on they charge an arm and a leg for the pens so I should imagine they would kick off if you started doing them.

Don't really know what the reaction would be from manufacturers most of them are most probably Classic Cars no longer in production but I bet the logos/emblems are subject to copyright.

Copyright laws on logos have been relaxed, I am unsure as to what exactly has been relaxed or to what extent.
I received a letter from my patents agent some 2 or 3 years ago telling me that he would no longer renew something due to a change in the law.
It was about the company logo but as the company is dormant I took no notice and filed it in the bin.
I now wish I had taken notice and could be your expert, alas that is not the case.
Certainly worth looking up at the copyrights office to find out for yourself.
Print your findings in the event you are questioned and show them in writing init?

Owners clubs tend to get a little leeway(or overlooked ;)) Afterall they have already bought the car, what more does the company want!

If it's to do with F1 then steer well clear, they are vicious in their defence of the brand. They will go after anyone, no matter how large or small.

they do have a plastic pen with the logo on it £14 for nothing more than a printed bic

You say nothing more than a printed bic, but the may have paid for a licence to reproduce it on bics for example that will cost money. Copyright holders may grant an exclusive or nonexclusive license to someone for a particular use, the licence holder will not be chuffed to find people infringing their licence.

Agree with you on that one. My son has just set up a plumbing / heating company called F1 Plumbing and Heating. No problems with registering the business but with regard to company logos -------- s**t fan hit no way.

It is worth looking at the website of the Intellectual property Office for information about the law relating to trade marks and copyright.

the f%$d owners club was not allowed to produce a calendar of owners cars
apparently f%$d decided that their cars ..even though sold and bought belonged to them

what a minefield

That doesn't sound right at all, I have produce many calendars with cars owned by individuals, there may be a problem if for example all the cars were BMWs and the calendar was called BMW Cars that might look like passing off, but with each month with a different or several different cars I don't see a problem. There must be something else the owners club weren't telling you.
